Warranty Policy (Malaysia)
How this document works
This Warranty Policy forms part of the Minarch Terms of Purchase, incorporated by clause 18, and is issued with your Sales Order. The version in force on the date of your Sales Order applies, and words defined in the Terms have the same meaning here. Section 4 sets out the conditions and exclusions that apply to all three warranties.
1. Sofa Warranty
1.1 What is covered. Minarch warrants sofas against manufacturing defects in materials and workmanship, under normal residential use and proper care, from the date of delivery.
| Component | Warranty period | Fully covered |
|---|---|---|
| Structural frame | 15 years | First 3 years |
| Manual mechanisms (reclining, headrest, footrest, sliding and sofa-bed mechanisms operated by hand) | 10 years | First 2 years |
| Seat foam and suspension (excessive sinking due to manufacturing defect) | 10 years | First 2 years |
| Upholstery stitching | 5 years | First 2 years |
| Motor and electrical components | 1 year | All 1 year |
1.2 How the warranty works. Minarch repairs or replaces a defective component at Minarch’s cost during the fully covered period; after that you pay a share of Minarch’s then-current price for the replacement component, on the scale below. Transport, delivery, dismantling, installation and labour are charged separately under section 4.
1.3 Every percentage in this table is the share you pay. Minarch pays the rest. Nil means Minarch pays all of it.
| Year defect reported | Frame 15 yr | Manual mech. 10 yr | Foam & susp. 10 yr | Stitching 5 yr |
|---|---|---|---|---|
| Years 1–2 | Nil | Nil | Nil | Nil |
| Year 3 | Nil | 30% | 30% | 40% |
| Years 4–5 | 25% | 30% | 30% | 65% |
| Years 6–8 | 40% | 55% | 55% | — |
| Years 9–10 | 60% | 75% | 75% | — |
| Years 11–12 | 70% | — | — | — |
| Years 13–15 | 85% | — | — | — |
1.4 Reading the table. Motor and electrical components are fully covered for their whole period. A dash means the period has ended. Your share is fixed by the year you report the defect, not the year of repair, and Minarch will tell you the amount payable before any work begins.
1.5 What counts as a manufacturing defect. A manufacturing defect is a fault in the materials or the making of the Product, not damage, wear, or the natural behaviour of a material over time. Minarch covers the following under each component line:
- 1.5.1 Structural frame. Cracking, splitting or breakage of a frame member, failure of a joint, weld, bracket or fixing, and frame instability arising under normal residential use without external impact.
- 1.5.2 Manual mechanisms. Failure of a mechanism to lock, hold, recline, slide or return; breakage or distortion of a linkage, hinge or pivot; and fixings working loose repeatedly after correct re-tightening.
- 1.5.3 Seat foam and suspension. A permanent indentation of 38 mm (1.5 inches) or more, measured at the deepest point with the seat unoccupied for at least 24 hours; collapse or crumbling of the foam; and breakage of a spring, webbing or suspension component. Minarch may measure the indentation when assessing a claim.
- 1.5.4 Motor and electrical components. Failure of a motor, actuator, transformer, control box, switch, remote or wiring loom supplied with the Product, unless caused by incorrect power supply, liquid ingress, or connection to equipment not supplied by Minarch.
1.6 What is not a defect. The following are normal characteristics of upholstery foam and are not defects, including:
- Natural softening. All polyurethane foam loses part of its initial firmness in the first 6 to 12 months; a reduction of up to 25% is expected as the cell structure settles.
- Height settling. A reduction in overall cushion height of up to 10% over time through regular compression.
- Cover relaxation, or puddling. Looseness, wrinkling or stretching of the fabric or leather seat cover caused by the natural settling of the foam beneath it.
- Uneven wear. Differences in softness between cushions caused by uneven use. Rotating and turning cushions regularly is required maintenance and is your responsibility.
1.7 Making a claim. Claims must be reported within the applicable warranty period with photographs, and Minarch may inspect the Product before deciding a claim.
1.8 What this warranty does not cover. Section 4 applies in addition to the following:
- Leather, fabric and other upholstery coverings. Once delivery is completed their condition is your responsibility, and any later change — wear, marking, stretching, fading, peeling, staining or abrasion — is treated as wear and tear.
- Normal wear and tear, including natural softening of seat foam, fabric stretching, wrinkles, creases, or changes in comfort over time.
- Natural characteristics of genuine leather, including grain variations, colour variations, scars, wrinkles, stretch marks and other natural markings.
- Cracking, peeling, fading or discolouration of leather, PU, fabric or upholstery materials caused by ageing, direct sunlight, heat, humidity or environmental conditions. This does not exclude failure of a finish or coating that is itself a manufacturing defect, as described in clause 1.5.
2. Natural Marble Warranty
2.1 Coverage to completion of delivery. Minarch covers cracks, fractures and breakages present when delivery is completed. Inspect the table at delivery and note any crack, fracture, breakage, chip, scratch, stain or edge-finish issue on the delivery order, or report it within 48 hours.
2.2 After delivery is completed. Each marble top has a bonded support panel across its full span and does not crack under its own weight, so any crack, fracture, chip or breakage arising after delivery is treated as wear and tear or applied-force damage and is not covered.
2.3 What counts as a manufacturing defect. A manufacturing defect in a marble, stone or glass Product is a fault in the material or in the fabrication — the cutting, edging, joining, bonding or finishing — present when the Product was made. Natural characteristics of the stone are not defects, and neither is anything arising after delivery is completed.
2.4 What is not a defect. The following are normal and are not defects, including:
- Veining, colour and pattern variation, including differences from a sample, a showroom piece or a photograph. Stone is quarried, not printed, and no two pieces match.
- Natural pits, fissures, dry seams and filled areas. These occur within the stone, and filling them is part of normal fabrication, not a repair.
- Visible joins where a piece is made from more than one slab.
- Resin yellowing. Yellowing or ambering of resin fillers, backing or finishes, whether from light and heat in use or from prolonged storage away from light.
- Etching — dull or lightened marks caused by acids such as lemon, vinegar, wine or unsuitable cleaners. This is a chemical reaction with the stone, not a fault in it.
- Staining. Marble is porous and absorbs oil, wine and ink. Sealing reduces this; it does not prevent it.
- Tonal change across the surface over time through light and use.
2.5 Use and loading. The table bears evenly distributed loads only. Do not sit, stand, kneel or lean on it, and do not move it by lifting from the top alone.
2.6 Care and maintenance. Clean with a soft cloth dampened with water or a pH-neutral cleaner, avoiding abrasive or acidic Products. Use coasters, placemats or tablecloths, wipe spills promptly, and keep heavy or sharp objects off the surface.
3. Chair Warranty
3.1 Wear and tear. Minarch does not cover wear and tear, including scratches, marks, stains, and dents on wood or metal legs. Inspect the chairs on delivery and report any issue on the delivery order, or within 48 hours.
3.2 Manufacturer defect coverage. Manufacturing defects — loose parts such as screws and swivel mechanisms, shaky legs and open stitching — are covered for 7 days after delivery, excluding damage from improper assembly, misuse or accidents.
3.3 What counts as a manufacturing defect. A manufacturing defect in a chair is a fault in the materials or the making — a joint, weld, fixing, frame member or line of stitching that has failed under normal residential use without external force. Damage, wear, and the natural behaviour of timber over time are not defects.
3.4 Levelness. A chair that sits level on a flat, even floor is within tolerance. Movement on an uneven floor is a floor condition, not a defect.
3.5 What is not a defect. The following are normal and are not defects, including:
- Grain, colour and tone variation in timber, between chairs in a set, and against any sample, image or showroom piece. On make-to-order furniture, slight colour and texture deviation arises naturally from differences in materials and process.
- Seasonal movement of solid timber — slight shrinkage, swelling or fine surface checking as humidity changes.
- Slight rocking on an uneven floor, assessed under clause 3.4.
- Fixings loosening with use. Re-tightening is normal maintenance and is your responsibility. Fixings that work loose repeatedly after correct re-tightening are a defect and are covered.
- Minor finish variation between production batches.
- Compression of seat padding with use.
3.6 Care and maintenance. Wipe down with a soft, damp cloth and avoid harsh cleaners. Position away from direct sunlight to prevent fading. Use felt pads to minimise scratches on floors. Rotate chair usage to distribute wear evenly. Lift the chair rather than dragging it.
3.7 Tilting. Chairs are designed for seated use with all four legs on the floor. Rocking or tilting a chair onto fewer than four legs puts the whole load on two legs and their joints, and damage caused this way is not a manufacturing defect. Minarch assesses the failure — where the break is, the direction of the fracture and the condition of the joint — and where it is consistent with tilting or rear-leg loading, the claim is not covered.
3.8 Improper use. For a chair, improper use under section 4 includes tilting as described above, overloading beyond recommended capacity, using it as a step stool, ignoring care instructions, modifying it in a way that compromises structural integrity, and outdoor exposure without protection.
4. Conditions That Apply to All Warranties
This section applies to the sofa, marble and chair warranties in sections 1, 2 and 3.
4.1 How appearance is assessed. Appearance is judged from a standing position about 1 m from the Product, under normal domestic lighting. A mark or variation visible only closer than that, or under directed light, is not a defect.
4.2 What none of the warranties cover. The following are not covered under any warranty in this Policy:
- Delivery, transportation, installation or service charges for warranty claims or replacement components.
- Products used for commercial, office, rental, hospitality or any non-residential purpose.
- Damage from accidents, misuse, abuse, negligence, improper handling or improper installation.
- Damage from burns, cuts, punctures, sharp objects, pets, insects or other external factors.
- Damage from improper cleaning, or the use of unauthorised chemicals, detergents, solvents, stain removers, conditioners or cleaning methods.
- Damage from corrosive substances, including acids, solvents, dyes, inks, paints and human or animal body fluids.
- Damage from flooding, excessive moisture, direct sunlight, heat sources or other environmental conditions.
- Products sold as display units, showroom samples, clearance items, used goods or on an “as-is” basis.
- Any repair, modification, alteration or replacement carried out by anyone not authorised by Minarch.
- Claims where the original invoice or valid proof of purchase cannot be provided.
4.3 Warranty conditions. The following apply to every claim:
- The warranty is valid only for the original purchaser and is not transferable.
- The warranty period runs from the delivery date on the original invoice, subject to clause 6.11 of the Terms of Purchase where delivery has been deferred at your request.
- Minarch may inspect the Product before determining the cause of a defect and approving a claim.
- Where a claim is approved, Minarch will at its discretion repair or replace the defective component with the same or an equivalent one.
- Replacement parts and materials may differ slightly in colour, texture, grain or finish from the original, through natural material variation or a change to the Product. This is not a defect.
- The warranty is limited to repair or replacement of the defective component and does not cover indirect, incidental, consequential or economic loss.
- Transportation, delivery, installation, dismantling and labour charges for warranty service are payable by you unless Minarch agrees otherwise in writing.
- Minarch may amend this Warranty Policy for future orders at any time.
